1. Acceptance of Terms

By downloading, installing, accessing, or using the BrightBatch mobile application (the "App") or the BrightBatch website (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App or Site.

2. Description of the Service

BrightBatch is a hands-free assistive tool designed for gig delivery shoppers. The App helps shoppers evaluate offer parameters (such as payout, distance, item count, and delivery requirements) and provides an automated acceptance capability based strictly on filters and rules configured by the user.

3. Accessibility Service & Permissions

BrightBatch requires Android Accessibility Service permissions to function:

• On-Screen Offer Inspection: The Accessibility Service inspects batch offer elements displayed on your screen to calculate offer scores.
• Automated Gestures: When you enable Auto-Accept and have an active credit balance, BrightBatch performs automated tap gestures to claim offers that match your criteria.
• Privacy Guarantee: BrightBatch performs evaluation locally on your device. We do not inspect, log, store, or transmit customer names, addresses, chats, or personal payment details.

4. User Responsibility & Platform Standing

You acknowledge and agree that:

• You are an independent contractor and are solely responsible for your relationship with gig platforms, including compliance with their Terms of Use and Independent Contractor Agreements.
• Using assistive or automation tools may conflict with certain platform policies. You assume all risks associated with using BrightBatch with your shopper account.
• BrightBatch and its developers are not liable for any account warnings, batch throttling, temporary pauses, or deactivations initiated by third-party delivery platforms.

5. Road & Driving Safety

Your safety and the safety of others is paramount. You agree to configure all filters, criteria, and settings prior to driving. You must never hold, adjust, or interact with your mobile device while operating a moving motor vehicle. Always comply with all applicable local, state, and federal hands-free and traffic safety laws.

6. In-App Credits, Vouchers & Purchases

• Free Core Features: Offer evaluation, scoring, and verdict displays are 100% free and do not require credits.
• Auto-Accept Credits: Successfully auto-accepting an offer consumes exactly 1 in-app credit.
• Digital Vouchers: Credits may be purchased as digital vouchers via authorized merchant platforms (including Payhip) and redeemed inside the App.
• Final Sale: Once a voucher is redeemed for in-app credits, all redemptions are final, non-transferable, and non-refundable. Credits hold no fiat cash value and cannot be redeemed for legal currency.

7. Anti-Abuse & Security

To protect system integrity, brute-forcing voucher redemption codes, reverse engineering API calls, or exploiting referral reward systems is strictly prohibited. Accounts engaging in suspicious redemption patterns are subject to automated rate limiting and lockout.

8. Disclaimer of Warranties & Limitation of Liability

THE APP AND SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIGHTBATCH AND ITS DEVELOPERS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL BRIGHTBATCH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE.
